About elder law

The different aspects of elder law

Medicaid eligibility and planning

New York Medicaid provides healthcare and long-term care coverage for individuals, including home/community based services and nursing home care. Planning can protect assets while ensuring eligibility.

Long-term care planning

Preparing for the financial, legal and medical aspects of extended care needs due to aging, disability or chronic illness.

Advanced directives

Preparing for potential diminished capacity and ensuring that people you trust can make decisions for you through Powers of Attorney (POA), Health Care Proxies, and other important documents. These tools allow you to designate trusted individuals to make decisions on your behalf regarding finances, health care, and other matters if you become unable to do so yourself.

Guardianship proceedings

When a loved one becomes incapacitated and does not have advance directives such as Power of Attorney or a Health Care Proxy, a guardianship may be necessary to appoint a person who can make decisions on their behalf. We guide families through this process, including bringing guardianship petitions, representing proposed guardians, and advocating for the rights of incapacitated individuals.

Guardianships for children

Establishing guardianships for children (including those with special needs) who require ongoing care and support as they transition into adulthood. This can involve coordinating with government benefit programs and ensuring the child’s long-term well-being.

Estate planning for Elderly New Yorkers

Creating wills, trusts, and other estate planning documents  for elderly New Yorkers to ensure your wishes are honored and your assets are distributed according to your plan after your death (or in the event that you become incapacitated.) Proper estate planning can also help your loved ones avoid legal complications.

Medicaid planning and applications

Most seniors will need long-term care due to a medical emergency, personal care needs or cognitive decline. But the expense can be a devastating financial burden.

Medicaid is often the only option for those who need but cannot afford long term care. We help seniors navigate the complexities of Medicaid eligibility – via Medicaid Trusts, Pooled Income Trusts, and other tools – even when there are assets or income above Medicaid’s limits.

Long-term care planning

We assist with Medicaid planning for long-term care needs, including home care, assisted living facilities, and nursing home care provided by Medicaid. We help families understand the legal implications of long-term care provided by Medicaid, and develop plans to access appropriate care while protecting assets.

Powers of Attorney (POA)

We help seniors prepare for potential incapacity by drafting durable Powers of Attorney, allowing them to designate a trusted agent to manage their financial and legal affairs if they become unable to do so. A properly executed POA can, in some cases, help avoid the need for guardianship.

Health care proxies

We help seniors designate a trusted individual to make healthcare decisions on their behalf if they become unable to communicate their wishes, ensuring their medical preferences are honored.
